U.S. Supreme Court Bans Mandatory Life Without Parole Sentences for Children

The U.S. Supreme Court issued an historic ruling in Miller v. Alabama holding that mandatory life without parole sentences for all children 17 or younger convicted of homicide are unconstitutional. Evan Miller, sentenced to life in prison without parole at 14, is now entitled to a new sentencing hearing. The ruling will affect hundreds of individuals whose sentences did not take their age or other mitigating factors into account. Human rights lawyer Bryan Stevenson’s journey to the Supreme Court came through the case of Evan Miller, who at the age of 14, along with two other boys, beat a man to death after hours of drinking and doing drugs with the man.  Evan received life without parole.  His friends, who took a plea deal, received sentences with parole.  Stevenson argued that death-in-prison sentences imposed on children are unconstitutional, and the Court has now banned those sentences for children convicted of non-homicide crimes and mandatory life without parole sentences for all children.
